Terms and Conditions

Please read this agreement carefully before accessing or using this site. By accessing or using the site, you agree to be bound by this agreement and agree to the terms and conditions below.

You also agree to our Disclaimers and agree to comply with Renterrific.com policies, which may be modified from time to time.

The following are the Terms and Conditions for use of the Service including, without limitation, vacation rental property listing and other Services which may be offered from time to time by Renterrific.com.  Please read them carefully.

Parties

This agreement is between the owner or authorized agent of a vacation rental property (“Member” or “You”),  and Renterrific.com.  The Renterrific.com web site is owned and operated by Kendelay, Inc., Carmel, Indiana (“Renterrific.com” or “Renterrific”).

Services
The use of this site  (“Services” or “Service”) is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices (“Terms and Conditions”) contained herein and by HTML Link. By signing up for Services, Member has agreed to these Terms and Conditions which represent the parties entire agreement and understanding. 

IF YOU DO NOT ACCEPT THESE TERMS AND CONDITIONS, DISCONTINUE USE OF THIS SITE.

Term

The term of a listing is for either one or two years, whichever the member selects, and becomes effective when a property listing is available to the public.  Subsequent  terms may be contracted at the then current rate prior to the expiration of the initial term.  Renewal, either automatically or through resubmission,  constitutes acceptance of any change to any of Renterrific’s policies or Terms and Conditions.  If a property is not renewed, Renterrific.com reserves the right, in its sole discretion, to continue to advertise the property with no additional cost to the member.

Fees
Renterrific.com will provide the listing service to the Member upon payment for the initial listing period.  Current fees may be found on the Fee Schedule.

If the member pays by credit card and signs up for the optional "auto renew" feature, Member authorizes Renterrific.com to charge the credit card upon the listing  renewal date at the then current rate for another one year term. The member may opt out of the "auto renew" option by contacting Renterrific.com thirty (30) days prior to the expiration of the current term.

Any amounts not paid to Renterrific.com  shall result in the discontinuation of service  until the account has been paid in full.

Cancellations, Transfers and Refunds
You may temporarily inactivate your listing and reactivate it at a future date. However, your listing agreement remains in force through the original term and the renewal date does not change.

If you sell your property, you may transfer your Renterrific.com listing to a new owner for a one time listing transfer fee. See the Fee Schedule for current charges.

If Member is not satisfied with the Service, Member may cancel their Service by notifying Renterrific.com. If cancellation is done prior to the first renewal date, Renterrific will refund the unused portion of your payment and discontinue your listing. Cancellation by Member will be effective 20 (twenty) days after the date on which Renterrific.com receives notice from the Member and the unused portion of your payment will be calculated as of that month end. This refund policy does not apply to any seasonal rentals that are available to the public  for less than 8 months per year, to time-shares or to customers with multiple properties listed. We will not refund any paid portion of a listing during a time of war, military action or terrorism.

Property Listings

Members are responsible for the accuracy of the information on their property listing page. Members who provide photos to be used on their page affirm that the photos are of their listed property and that they have the publishing rights to the photos.

Members are expected to follow our Acceptable Content Policy.  Listings that do not adhere to this policy are subject to cancellation at the sole discretion of Renterrific.com.

Member acknowledges that Renterrific.com may, at any time, whether due to the receipt of a complaint or for any other  reason, remove or alter some or all Member material.

Renterrific.com reserves the right to reject or edit any listing submitted at our sole discretion. Once material has been submitted, edited and published on the Renterrific.com web site, it becomes the property of Renterrific.com  and may not be copied from the site without the express written permission of Renterrific.com.

Should the property not be renewed at listing expiration, in its sole discretion, Renterrific.com reserves the right to  change contact information and redirect inquires.

Members may not share accounts.  If it is determined that an account is being shared by members, Renterrific may, at its sole discretion, choose to remove one or both Member sites.

Disclaimer of Warranties: Limitation of Liability
Member acknowledges that Renterrific.com has not made any representations or warranties with respect to the quality of the Service or that the Service will be accessible on a continuous basis or that such accessibility will not be limited or interrupted from time to time.  Renterrific.com specifically disclaims any such representations, warranties, or covenants.

Renterrific.com disclaims all express and implied warranties with regard to the information, services and materials contained on this site including without limitation any implied warranties of merchantability, fitness for a particular purpose and non-infringement. All such information, services, and materials are provided AS IS and AS AVAILABLE without any warranty of any kind.

Renterrific.com does not represent any of the property owners.  Renterrific.com cannot guarantee the validity or accuracy of any statement made on the property listing pages or those of any other party.

Renterrific.com is not responsible for any action, or omission of action, by any renter or potential renter or any other party obtained by the use of this site.

Renterrific.com is not a licensed real estate agent in any state. Any arrangements made between property renters and owners are made independent of Renterrific.

In no event shall Renterrific.com be liable for any special, indirect, punitive, incidental, exemplary or consequential damages, or any damages whatsoever resulting from loss of use, business data or profits, litigation and the like, whether based on breach of contract, tort (including negligence), product liability or otherwise, even if advised of the possibility of such damages. 

Member acknowledges and agrees that the limitations set forth above are fundamental elements of this agreement and this site would not be provided to you absent such limitations. Some state statutes might apply regarding limitations of liability.

Member Materials Indemnification
Member represents and warrants that any material which Member places on the web site will not violate the rights of or harm any 3rd party.  Member also represents and warrants that any material which Member places on the web site will not give rise to any claim of such violation, will not violate any federal, state or local law, rule or regulation of any type and/or will not contain or transmit any software disabling devices, internal controls, or spamming agents.

Member shall indemnify and hold Renterrific.com and its employees, agents, shareholders, officers, directors and successors and assigns harmless from and against any and all claims, damages, liabilities, costs and expenses (including attorneys' fees and costs and settlement costs) related to your violation of this agreement, and/or your posting of material to this site.

Termination
Renterrific.com may terminate the listing and the Member's right to use the Service at any time without cause by sending notice to the Member.

Renterrific.com may terminate the listing and the Member's right to use the Service without notice upon determining that a breach of these Terms and Conditions has occurred, even if said breach is rectified.

In addition, Member may terminate this Agreement by giving written notice to Renterrific.com and discontinuing use of the Service. Terminations by Member will be effective 20 (twenty) days after the date on which Renterrific.com receives notice from the Member.  Member will be liable for fees through the end of the current listing period.

No refunds will be given if the Member cancels the listing services after the first year of service, or if Renterrific.com cancels the listing services due to a breach of these Terms and Conditions, and under no circumstances will any termination of this contract result in a refund exceeding the unused portion of any fees paid to Renterrific.com.

Changes in Services, Terms and Conditions, and Fees
Renterrific.com may make improvements or changes in the information, services, products, and other materials on this site at  any time without notice. Renterrific.com may modify these Terms and Conditions or Service prices and may discontinue or revise any and all other aspects of the Service in Renterrific’s  sole discretion. Member shall be deemed to have accepted any such changes or modifications by continuing to use the Service.

Proprietary Rights

All materials on this site, except property information and photos, are owned and copyrighted by Renterrific.com and may be accessed, downloaded or printed for your personal non-commercial use only.

Without the prior written permission of Renterrific.com, you may not copy, distribute or transfer any material, in whole or in part,  on this site.

Member acknowledges and agrees that Renterrific.com may use, copy and redistribute any and all information provided to it including, but not limited to, name of property, artwork and trademarks for promotional and advertising purposes without limitation.

Miscellaneous
These Terms and Conditions shall be governed and construed under the laws of the State of Indiana.  Any dispute arising out of these Terms and Conditions or any Services provided by Renterrific.com shall be resolved in the Federal or State courts located in Hamilton County Indiana and Member consents to the jurisdiction of such courts over Member.

All notices given by member shall be in writing and addressed to: Renterrific.com  P.O. Box 254, Carmel, IN  46082.

All notices to Member shall be given either in writing, via regular mail, email or via telephone to the address, email address, or telephone number provided at the time of signing up for service.
